2008 Proposed Amendments to the Navajo Nation Safe Drinking Water
Act

The Navajo Public Water Systems Supervision Program is proposing to amend the
Navajo Nation Safe Drinking Water Act (NNSDWA).  Section 2506, 2542, and 2562 will
be amended.
Navajo Nation Safe Drinking Water Act

The Navajo Nation Safe Drinking Water Act, (NNSDWA), was initially adopted by the
Navajo Nation Council in 1995. The NNSDWA has been revised to include the
Underground Injection Control’s provisions for protecting underground sources of
drinking water from activities conducted by the oil and gas industries. In 2001, the
NNSDWA was revised again to incorporate the revised public water system definition,
provisions for the operator certification requirements, the consumer confidence report
requirements, amendments to the variances and exemptions of the NNSDWA and
amendments to the judicial section.
2) 2542: Reporting Results of Tests and Analyses amendments will clarify the provisions.
3) 2562: Small Systems Variance will be amended to correct the citation from paragraph 9 to subsection H.

The proposed amendment were publicly noticed on November 1, 2008 with an initial deadline to provide comments by
December 1, 2008.  The
deadline date has been extended to December 30, 2008.

The NNSDWA amendments was prepared pursuant to the NNEPA Uniform Regulations for Permit Review, Administrative
Enforcement Orders, Hearings, and Rulemaking under the Navajo Nation Environmental Acts (Resources Committee RCS-155-
